1. About us
FilmsJackets is a trading name of Prime Promo Gear Ltd, a private limited company registered in England and Wales under company number 17397732. Our registered office is 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom. Our website is filmsjackets.com.
You can contact us about an order at filmsjackets@gmail.com. Our registered office is a legal correspondence address and is not a returns address unless we expressly confirm otherwise.
2. These terms
These Terms & Conditions apply to your use of our website and to purchases made directly from us through the website. Please read them before placing an order.
If you are a consumer, nothing in these terms limits or excludes any statutory rights that cannot lawfully be limited or excluded. If you live outside the United Kingdom, mandatory consumer laws in your country may also apply.
3. Products and product information
We take reasonable care to describe products accurately. Colours, textures and grain may vary slightly because of screen settings and the natural characteristics of materials such as leather.
Measurements and size charts are guides. Where a product is offered in a standard size, selecting a size does not by itself make the item personalised or bespoke.
Some products are made after an order is placed. A standard made-to-order product is different from a genuinely personalised or made-to-measure product. We will identify genuine personalised or made-to-measure products before you place the order.
4. Orders and contract formation
When you place an order you are making an offer to buy the products shown in your basket. We will send an order acknowledgement by email. A contract is formed when we send an order confirmation accepting your order, unless we have already made clear at checkout that acceptance occurs at another stated point.
We may refuse or cancel an order before acceptance where, for example, a product is unavailable, the price or description contains an obvious error, payment cannot be authorised, we reasonably suspect fraud, or we cannot lawfully supply the product to the delivery destination. If we have taken payment for an order we do not accept, we will refund it.
5. Price and payment
The total price payable for products will be displayed clearly before you place your order. Mandatory charges that we know and control will not be hidden until the end of checkout.
Delivery charges, where applicable, will be shown before you place the order. UK orders are shipped on a delivery duty paid basis, so you will not be asked to pay import VAT, customs duty or clearance fees when your parcel arrives. For deliveries outside the UK, the destination country may charge import duties or taxes, which are paid by the recipient unless we state otherwise at checkout.
Payment is processed securely by the third-party payment provider shown at checkout. We do not store full card numbers on our website.
6. Made-to-order, personalised and made-to-measure products
Many FilmsJackets products are produced after an order is received. This production method does not automatically remove consumer cancellation rights.
Where you request genuine personalisation or production to your individual measurements or specifications, the product may fall within the legal exception for personalised or custom-made goods. We will identify this before checkout. Change-of-mind cancellation rights may not apply to those products, but your rights remain if the product is faulty, not as described or otherwise does not conform to the contract.
7. Delivery
The estimated production and delivery timeframe will be shown on the relevant product page, checkout or order confirmation. Our current general target for many orders is approximately 13 to 15 working days in total, unless a different estimate is stated. See our Delivery & Shipping Policy.
Unless we agree a different period with you, we will deliver within the period required by applicable consumer law. For UK distance sales, goods should generally be delivered within 30 days unless another period has been agreed.
Delivery estimates can be affected by custom work, material availability, courier delays, customs, weather or events outside our reasonable control. We will contact you if a material delay occurs.
Please provide a complete and accurate delivery address. Contact us promptly if you need to correct it; we cannot guarantee a change once production or dispatch has begun.
8. Risk and ownership
Risk in the goods passes to you when the goods are delivered to you or to a person you nominate to receive them, except where applicable law provides otherwise. Ownership passes when we have received payment in full.
9. Your right to cancel standard goods
If you are a UK consumer buying standard goods online, you normally have the right to cancel without giving a reason within 14 days after the day you receive the goods.
After telling us you wish to cancel, you normally have a further 14 days to return the goods. Please use the instructions in our Returns, Refunds & Exchanges Policy and our model cancellation form if convenient.
You may handle goods only as reasonably necessary to establish their nature, characteristics and functioning, similar to what you could do in a shop. We may make a lawful deduction for loss in value caused by handling beyond that level.
The statutory cancellation right does not normally apply to genuinely personalised or custom-made goods. It also does not affect your rights if goods are faulty or not as described.
10. Returns, refunds and faulty goods
Our Returns, Refunds & Exchanges Policy forms part of these terms. It includes our voluntary 30-day returns arrangement for eligible standard goods as well as your statutory rights.
If goods are faulty, damaged, not as described or do not conform to the contract, you may have rights to a refund, repair or replacement under applicable law.
Refunds will be made to the original payment method unless we lawfully agree another method with you.
11. Promotions, sale prices and discount codes
Promotions may have additional terms stated with the offer. We will present prices and mandatory charges clearly. Any reference price used for a discount must be genuine and not misleading.
Discount codes have no cash value, may be restricted to certain products or dates, and cannot be combined unless we state otherwise.
12. Accounts and website security
You are responsible for keeping your account credentials confidential and for information you provide through your account. Please tell us promptly if you believe your account has been compromised.
You must not misuse the website, attempt unauthorised access, introduce malicious code or use the website for unlawful activity.
13. Reviews and user content
If you submit a review, image or other content, it must reflect your genuine experience and must not be unlawful, defamatory, misleading, abusive or infringe third-party rights.
We may moderate content for relevance, legality, fraud or abuse. We do not remove genuine negative reviews merely because they are negative. Incentivised reviews must be clearly disclosed. See our Consumer Reviews Policy.
14. Intellectual property and third-party references
The website layout, original text, photography, graphics and FilmsJackets branding are owned by us or used under permission, except for third-party rights that remain with their respective owners.
Film titles, character names, celebrity names, sports teams, logos and other third-party names or marks may be protected by intellectual-property rights. Unless we expressly state that a product is licensed or officially authorised, no affiliation, endorsement or sponsorship should be assumed.
15. Our liability
Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or liability for breach of statutory consumer rights.
If you are a consumer, we are responsible for foreseeable loss or damage caused by our breach of contract or failure to use reasonable care and skill, but not for loss that was not foreseeable. We do not exclude rights that cannot lawfully be excluded.
The website is intended primarily for consumer purchases. If you use products for business purposes, separate business terms may apply.
16. Events outside our reasonable control
We are not responsible for delay or failure caused by events outside our reasonable control, but we will take reasonable steps to minimise the effect and will comply with any consumer rights that arise because of delay.
17. Complaints
Please contact filmsjackets@gmail.com first so we can try to resolve the issue. This does not affect your right to seek advice from Citizens Advice or to use any court or dispute-resolution rights available to you.
18. Changes to these terms
We may update these terms for future orders. The terms that apply to your purchase are the version provided or made available when your contract is formed. We will not retrospectively change an existing contract without a lawful basis.
19. Governing law and jurisdiction
These terms are governed by the laws of England and Wales. If you are a consumer, you may also benefit from mandatory protections of the country in which you live.
The courts of England and Wales will have jurisdiction, but consumers in Scotland or Northern Ireland may generally bring proceedings in their local courts where the law allows, and consumers elsewhere may have mandatory local jurisdiction rights.
